esa new claim

esa new claim was created by dennygilly
I have been recieving esa contributions based which runs out on 29th August.I have an appeal on 1st Sept. I have been refered to consultant as pain and swelling to my ankle is now chronic.If I lose the appeal can I reapply for esa as condition has got steadily worse throughout the year. Thank you.

From your previous posts I believe you are in the WRAG and appealing to be placed in the Support Group.
If your ESA is being time limited then technically you remain eligible for ESA just not entitled to payment.
Have you checked whether you would be eligible for Income Related ESA? If you are then your payments will continue as long as you qualify for ESA. ESA(IR) is dependant on your household income, your savings and assets, and any hours that your partner works. See

24 hour work rule for ESA(IR)
If you are not eligible for ESA(IR), then you can only make a new claim for ESA(CB) if you can re-meet the Contribution Conditions, this would be for the Tax Years 2012-13 and 2013-14. You need to be sure that you have sufficient NI Contributions to meet the requirements as you may need to close your existing claim in order to make a new one.

From your previous posts I believe you are in the WRAG and appealing to be placed in the Support Group.

I was not placed in wrag group had assessment rate re instated when appeal was accepted.Should be alright with contrubutions.Do I just make a new claim when it ceases.

If you make a new claim before a Decision is made on your existing claim then you will not receive any back payments for the current claim, you will need to separate the two claims by more than 12 weeks and it will be a completely new claim.
Whilst it should not be a problem based on your current payments stopping on 29 August, if your new claim is made on or after the first Monday in 2016 then the applicable Tax Years will move up one year.
