My apologies if this has been asked before ..
My son has had epilepsy since school days, now grown up and married ...
To cut a long story short I have been a full member here for some time and you have often helped when all was lost
He is on DLA for mobility and care and is in the support group ..
This morning his wife received a letter stating the carers benefit she receives for him is ending by 1st September when his DLA finishes .... that was a shock as they had no idea ....phoned about the carers benefit and they said DLA should have sent him papers to fill in before now and to phone them
My son has really bad issues of speaking on phones so his wife phoned and they rightly asked to speak to him, but rather than going back to his wife they questioned my son, who suffers lots of anxieties because of epilepsy answered questions he wife had no idea what they were asking, and he has memory lapses anyway and couldn't tell her ....rather than ask to speak to her the person on the phone discontinued the call after saying they would send out papers and if he was lying he could be prosecuted !!
I am sure people on here will understand what this has done to him ...he is a wreck ... and his own doctor who always fights for him, is on extended leave till 1st October !
If there is any advise you can offer we will be very grateful ...knowing this will just lead to more seizures ...he hasn't been on the support group long and that only came after advice from yourselves here and me attending a tribunal with him where they were very supportive and helpful ..
Please help if you can with some advise ...
Yes, we did know DLA was changing to PIP eventually ....

Was your son able to relate the call in detail or was it too much for him to take in?
You need to know what forms the DWP are sending, whether they are for DLA or for PIP, I suspect the first given the comment about prosecution (you should ignore this as I see know relation in this situation to any fraud).
There are two potential scenarios.
The DWP accept that a renewal form for his DLA was not sent and that this was there fault, in which case DLA forms should be send and he will be re-assessed for DLA, or, that DLA forms were sent and it is your son's fault that they were not returned in time, in which case he will be sent PIP forms.
If there is still some confusion over the phone call, then they should be able to make a new one, your son will need to be available to answer the security questions and to authorise the DWP to speak to his wife and then she should be able to take over the call. If there are still problems, ask to speak to a manager, which will require a callback.

Now today he has received his last payment and has been told he will be on ESA and will have to go to job interviews etc . !!
I cant understand this at all .... he is supposedly in the support group, and got in there for a reason, yet they can just do this immediately ....his wife was told the carers allowance will stop as his DLA is stopped ...?????
He is a wreck at the moment, they have two small children and that is a lot of money to lose , but more importantly is very detrimental to his health ...these things always bring on more seizures.... he thought his own doctor was on extended holiday but now finds there has been a family crisis and he will be resuming work in October but only for a couple of days which is too late for his help ...this doc has been very good with him, changing meds trying stuff out etc
I asked him what the DLA person had asked him on the phone, but he said he can't remember and didn't understand much anyway ...the seizures have changed the past couple years and he gets memory loss....
He said another one of the dads at the school when they pick the children up, has had same problem , stopping his ESA as they said they hadn't received papers back, but again he had not received them and they take no responsibility for that ?
They have been told it can take up to 3 weeks to get the papers sent out then he will have a certain amount of time to get them back to them ...but very short of money up till then ... and now he dreads that it will end up in a tribunal once again as it did when the local office told him he should be in the support group, which was agreed by the tribunal ..
We are just at a loss with all this and very grateful for any comments as to how to proceed

Can I please add ..... you mentioned DLA and PIP forms ...I was under the impression all DLA will now be PIP is that not correct ?? So should David get DLA forms or new PIP forms

I'm afraid someone needs to phone the DWP to find out what is going on.
A call needs to be made to the DLA unit to find out what is happening with his claim, your latest post suggests that they have closed his DLA claim and the forms they are sending are for PIP.
Secondly someone needs to call the ESA unit to find out what group he is in and if he has been moved to the WRAG when this happened. Any such move would require a Decision to have been made and he is entitled to written notification of this.
I would recommend they get face to face advice, we are limited in the help we can give on the forum without sight of the documentation. Do an internet search for "welfare advice" with their postcode, town or county.
