ESA - against

PIP - for

ESA is particular assumes the use of aids and appliances even if the claimant does not use them or even own them.

Gordon,

What if:

1. A claimant owns an aid or appliance but finds it of no help or of limited value?
2. A claimant has owned an aid or appliance in the past but did not find it of help?

In completing an ESA 50 I referred to equipment that I had purchased and either found of no help or could no longer use due to the progressive nature of my condition. How should a claimant approach the same issue on a PIP 2?

For either benefit you need to show that the usage is not reasonable, this may be because you are physically or mentally unable to use the aid of appliance, you have received medical advice not to use it or it is not practical for you to use it.

Finding something of no help may be disregarded by the assessor or the Decision Maker unless you explain why, I would try and relate it to your doing the task reliably, so as an example an aid might introduce the risk of injury or it may allow you to perform a task but not within a reasonable time.

Gordon,

Thank you. The approach you describe is exactly the line I'm taking in writing up answer for the eventual PIP 2.
