i have a dla appeal on wednesday next. i visited my gps surgery last tuesday and paid them the fee for releasing my notes to the tribunal.
today however, i received a letter from the appeals tribunal in omagh saying they havent received the notes and will need them 3 days before the tribunal sits. as monday is a holiday, i wont be able to contact my gps surgery until tuesday which is the day before the tribunal
in this scenario are those sitting on the tribunal likely to disregard the notes as they may not have time to read them.
is any action advisable.? should i complaing to the manager of the surgery.
this is so depressing and i feel helpless
any ideas plz?
i also received a bill for 1500 pound overpayment which i feel is premature as the appeal is still ongoing. it hasnt been my week

To a considerable extent it will depend on who has requested your medical notes.
If it was the Tribunal panel then they may well adjourn the hearing until they are available.
If the request was made by you then you should first ask for an adjournment so that the notes can be made available. The Judge make take the view that you have had adequate time to make the information available, you should have had a minimum of one month to prepare and submit your information for the hearing. If this happens then depending on the result of your hearing, you can appeal to the Upper Tier Tribunal to have the Decision Set Aside due to the missing evidence, but it is likely to depend on how important the information is viewed in regard your case.
In either case, your starting point is to contact the Clerk of the Court, the phone number is on the letter informing you of the hearing date.
