ESA Support group, permitted work was created by dispow
Hi All,
I have had a client whom is in receipt of ESA support group...
He wants to start working for a close relative within her business. I know the limitations on hours and rate of pay but whats cloudy to me is that I cannot find anywhere if permitted work is allowed in regards to being employed by a close relative. I know voluntary work is not accepted when it comes to close relatives but it doesn't specifically say permitted work is within that rule.
I personally think this would be a great opportunity for confidence, independence along with many other factors.
I just need to know if its allowed.

I'm not aware of anything in the legislation that restricts who the claimant works for, ultimately the decision lies with a DWP Decision Maker who may factor this in. so I would include the information of who the employer is on the PW1 form,
A couple of things to make your client aware of;
- If the exceed the Higher Limit for earnings, even by 1p, then their ESA claim will be closed with limited right of appeal.
- Whilst their starting PW should not result in a re-assessment of their claim, it will be considered when they are re-assessed, so they need to be very certain that the PW does not conflict with their stated limitations on the ESA50.
