Thank you Gordon.
I originally filled in a claim for ESA in 2012, not sure what form it was can't put my hands on it at this moment I would have told the DWP that owned property with my then husband (divorce proceeding were in early stages at that time) with a mortgage and applied for and eventually got mortgage interest support. Divorce proceedings and settlement took a very long time. Whilst my ex husband agreed to sign over his share to me following a court order the mortgage company have not authorised anything that was in the court order (which isn't recent) to release his name and/or enable to legally put it in my sole name at the land registry. As I said solicitor's involved. I am so worried about this now probably won't sleep tonight. Should I call the DWP 1st thing in the morning and try my best to explain?

As your solicitor has already told you that they don't know benefit law, you need to speak to a trained benefit advisor before you call the DWP.

This is only an issue if you are not living in the property in question which seems to be the case from your post.

Thank you once again Gordon.

I am not sure if there has been some confusion, could be I didn't explain very well or I am not reading your advice very well, more than likely.

There is only one property involved in this info, myself, my husband and our 2 children lived in the house before we separated and he left. There after myself and the children still live in this property which is mortgaged. I have no interest in any other property now or before.

Would the CAB be able to help?

If this property is the one that you are living in then this is disregarded as an asset for the purposes of benefits and there should be no issue.

I did contact "Turn to us" earlier and CAB they both said as far as they know the same as you have now said. Someone who is an expert in these matters from CAB is calling me on Monday too.

So hopefully I can stop worrying.
