PIP Confusion was created by blondi82
I got awarded pip yesterday, I didn't get what I expected.
I was even more upset to find the assessor had written lies about me. she even said how I came alone via public transport, when my dad was there for the whole thing and brought me by car. But how can I prove this?
I was very upset after the assessment, there computers were down and she was writing things on paper and I could see she wasn't writing all what I was saying down.
She was quite nasty at times saying I should do more things for my self, and that some of my problems were to complex so she wouldn't write them down I left in tears.
I really want all the lies taken off my record but how?
Many Thanks

Welcome to the forum, you might want to have a look at the following FAQ which explain where everything is
Welcome to Benefits and Work
Are you wanting to challenge your award for a higher one or to make a complaint about the assessor as these are entirely separate things?
For a complaint, follow the links on the following Maximus page
www.chdauk.co.uk/contact-us
If you want to challenge the Decision then the first thing I must warn you about is that any existing award can be reduced or even removed, the risk is low but this does happen on a regular basis.
You should give some through to how strong your existing award is and how likely you are to gain the extra points you need for an increased award, have a look at our PIP claim guides for a better understanding of the PIP criteria, it is easy to misunderstand the criteria from the PIP2 form and not include important information.
If you want to go ahead then the first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process and template letters that you can use to make the request with.
www.benefitsandwork.co.uk/help-for-claimants/pip
You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.
Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;
"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"
than their opinions
"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.
When you have a better idea of the issues with your claim, come back to the forum and we will do our best to help.

Thank You for your help.
I have looked at all your guides I got standard on both, I am not 100% I would get more and I am happy with what I got I just have one issue. I had the battle of my life going from incap to esa (wish I had been a member then). My only concern is without Reconsideration / Apeal is there away to try get the bits the assessor lied about on my pip report so esa don't get hold of it?
That's really the only reason I want to appeal the lies, I am happy with money.
Just to clarify I am now On:
ESA - Support Group -Contributions Based
Pip - Standard daily and Mobility
Thanks again

Realistically there is little that you can do about this.
If you ask for an MR then you open the whole award up to review with the risk, albeit small, that your current award can be reduced or removed.
If you make a complaint and the report is withdrawn as being not fit for purpose then you risk potentially undermining your current award, risking an early re-assessment..
It's highly unlikely that the report will be used for any future review, so personally I would not bother if you are happy with the award you have.
