My Husband was on indefinite DLA. He turned 65 in November 2013. At the beginning of April he had a letter telling him he HAD to apply for PIP by the 21st April or he would loose his DLA. I thought people over 65 were not being changed? His letter said he had to change because he was 65 after 5th April 2013. Anyway it was worded in such away that he had no choice he had to do as they said or he would have nothing. We did as they said, we went for his assessment/consultation in May. His letter came through 2 weeks ago he has been awarded only standard rate for both care and mobility, meaning his mobility car will have to go back. Since then he has suffered one angina attack after another through the stress, even though it was on his forms he is not to be stressed, We have Army war pension's writing a letter to confirm all we have said is true along with a half hearted letter from our outgoing GP plus our own letter pointing out the irregularities on the decision and why we do not agree with parts of it. These have all gone in for the reconsideration now it is just a game of wait and see. We asked for the report from his consultation but have yet to receive it. I have heard they employ delaying tactics. My husband will be housebound with out the car as he can not walk more than 15 - 20 metres or use public transport which we went to pains to tell them over and over again. They did not give us time to question why they were forcing him on to PIP when he is 66. I suppose there is nothing we can do about it now? We think they will stand by there decision so will have to go to appeal. Any advice as to whether we could have put a stop to this or if we just have to go with the flow and hope for the best. From what you have said, the transfer process happened as it should have and there is nothing you could have done to change it. As you were told by DWP, all DLA claimants who were aged under 65 years on 5th April 2013 will be 'invited' to claim PIP at some stage. Once this process has been initiated the claimant has no choice but to conform as anything else would result in the DLA claim being closed anyway.

If your husband has been a Motability customer for a few years he should be entitled to a small payment that would help towards the purchase of a secondhand vehicle.

If the MR does not go in your husband's favour, you can then submit for a formal appeal. Our PIP guides talk you through the claim process, MR and appeal.

I posted on here a few months ago but can't find the post. My husband was forced on to PIP back in April after 17 years on DLA with an infinite status. The PIP letter was worded in such a way that he had to move to PIP or he would lose his DLA, (he was for want of a better word threatened) His consultation took place on 11th May with the decision letter arriving the first week on June. He had been awarded 8 points of care and only 10 for mobility, which meant he would lose his mobility car. We asked for a reconsideration and outlined everything we did not agree with. This letter was accompanied with a letter from Army Welfare who had been out to see my husband twice so could see just had bad he was. Today 1st July we had a letter with the result of the reconsideration. They refused to up his care but they did give him the 2 points he was short off to move up to the enhanced mobility which means he will now not lose the car. We still do not agree with everything they have said in his letter but as we are still waiting on a copy of the report which no doubt we will not receive, we feel we can not rock the boat any further and go to appeal. As we are luckier than most we are going to stick with what we have.

I have written another post as I couldn't find this one. The result of my husband's reconsideration is they have given his the enhanced rate of the mobility component so he will not lose his mobility car now. We are happy about this so will not rock the boat and go to appeal even though there are parts that are still not correct. AND still waiting on the original report.
