what happens when sending off renewal form late? was created by limited
Hi, what happens when sending renewal form off late? before the day it expires but less than 1 month before it expires? surgeon messed up when I was in hospital for day surgery, and then I was in hospital for a further two weeks. I was unable to complete form immediately after discharge wasn't able to think of answers due to significantly reduced cognitive functioning. so had to wait until my thinking memory, processing, recall, etc was starting to improve before I could complete form. Will my benefits be suspended until they process application form? or will they will be stopped completely and I will have to make a completely new application? I don't wnow what the law is regarding this.

You don't say what the benefit is, I'm guessing DLA from your other post but for completeness I'll cover the three main benefits.
ESA is a indefinite award so your ESA payments will continue until a new Decision is made, however, the form has to be returned by the required date or claim could be suspended of even closed, providing it is not too much after the required date, DWP procedure is to continue with the re-assessment.
For DLA and the renewal of a Fixed Term award, payments will stop on the date that the award ends, if your forms are returned before this this then any new award will be back dated to the end of the previous award. If your forms are not with the DWP by the end of the award then your claim will be closed and you will only be able to make a new claim for PIP.
For PIP the forms must be returned to the DWP by the required date, if they are not then the most likely result is that your claim will be closed and you will have to make a new claim from scratch.
The bottom line is return the forms by the required date using a tracked post and confirm with the DWP office dealing with your claim that they have received them.

THanks. Its a fixed term DLA renewal form (which surprised and confused me because I thought all DLA had been replaced by PIP).

PIP will shortly cover the whole of the UK mainland but there is a 20 week lead time to invitations which is probably why yours was still a DLA renewal.
As previous posted, it is essential that you return and confirm receipt of your forms before your current award ends.
