PIP Decision Query was created by MSB Duckworth
Hello I am new to this forum and need some advice please.

I applied for PIP in January this year.

I completed the paperwork before I found this site.

I had a face to face appointment around the middle of February.

I received a Personal Independence Payment Decision on the 9th March. The was for PIP at the standard rate. I am unhappy about this decision. I do not know how the Capita Interviewer reached her decision.

I was accompanied to the face too face by my mother, who is my carer, we where not told who the person was or their qualifications. During the face to face I suffered a blackout, and the interviewer could surely see the stress it caused my mother.

I had hoped too be awarded the enhanced rate of pip so that I could afford to pay for additional care. My mother is 76 years of age and has Rheumatoid Arthritis. She is finding it very hard work to provide all the care I need. We cannot claim a carer's allowance as she is in receipt of the state pension.

I think the scoring is unfair especially the section on managing toilet needs or incontinence I was given a score of zero despite the fact that we both explained to the assessor that my clothing often has to be changed several times a day my mother has to cope with all the washing. For planning and following journeys I was given a score of zero and also zero for moving around. Due to my blackouts my GP and cardiac consultant have said I must always be accompanied as it is frequently necessary to call an ambulance.

On the seven page letter we were not given any details of the assessor or if this letter was actually the medical report. Where do I go from here?

Welcome to the forum, you might want to have a look at the following FAQ which explain where everything is

Welcome to Benefits and Work

In case you are not aware, your real name appears to be showing in the forum, if you want to change this then follow the instructions in the following FAQ

My full name is showing, how can I stop it?

I removed your name from the bottom of your post in case you do want to change your forum name.

What you have received is the Decision Letter which includes the Decision Maker's Statement of Reasons, it is the DM that makes the Decision on a claim not the assessor who only makes a recommendation.

So the first thing you should do is contact the DWP office that dealt with your claim and ask for a copy of your assessment report, if you phone then we recommend that you follow up the request in writing.

Next you need to request a Mandatory Reconsideration of the Decision, this is the first stage of an appeal. Have a look at our PIP MR & Appeal guide for details of the process and template letters that you can use. I would include a statement that you will be supplying additional information once you have received the assessment report. See

www.benefitsandwork.co.uk/help-for-claimants/pip

Next, have a look at our PIP Claim guide (above link), this explains each of the PIP Descriptors that you are assessed against in detail, a good start is to compare it your claim form and when you get it the assessment report, to see if you could present you answers better.

Your primary goal is to show that you meet the PIP Descriptors sufficiently for an Enhanced award, whilst it is still important to show that the assessors and DM's opinions on your capabilities are faulty, doing this alone will not result in an increased award.

I do need to warn you that challenging the Decision, brings the whole award under consideration, whilst it would be unusual for an existing award to be removed, it none the less is a possibility that you must consider.

I you have any specific questions then please reply to this post and we will do our best to help.
