Hiya,
I was awared higher rate care and mobility after an ATOS doctor came to my house and assessed me two years ago. I recieved the renewal claim last August, my claim being ue to stop on 9 Jan this year. I filled it out and sent it off in its prepaid envelope.
I never thought anything more until I noticed that my January ESA payment was over £120 short. When I queried it I was told I had lost the severely disabled part of my ESA since I was no longer recieving DLA.
I called the DLA who told me they had never recieved my renewal and that my claim and entitlement ended on 9 Jan. I was told to apply for PIP which I did (on 5.2.15).
I have been given a PIP assessment date of 1/4/15, but I know that the ATOS doc has to write report, then it is handed on to a decision maker so it could be months yet before I have a decision.
In the meantime, I am over £850 a month down. I cannot afford to pay for help with my care, with my housework, I do not now have a blue badge, I cannot afford my car tax or even petrol and I am struggling getting food.
We live in a remote area with no public transport and I am a single, disabled parent to two children. My phone will be cut off in the next couple of days so I will have no contact with the outside world.
I went to the CAB, who asked for a mandatory reconsideration, and have just recieved a letter saying that because they did not recieve my renewal, there is no decision to be reconsidered.
I have even provided them with a photocpoy of the form I sent away in their prepaid envelope. I didn't get proof of postage because I have never ever needed that witha prepaid envelope before, plus, my local post office is a few miles away and my health did not allow me to stray that far from home. I had to use my local post box.
CAB have told me there is nothing more they can do. Even if everything goes swimmingly, which I doubt, I will not get any money to cover the space from the 9 Jan, when they stopped my DLA until the 5th Feb when I noticed that and applied for PIP.
I don't know what to do.
I don't know how we will survive until a decision is made.
My pain and illnesses are through the roof as a direct result of this and I don't know how I can carry on.
I have already been given a food bank package from the CAB, but apparantly I am only entitled to 3 a YEAR. I am too scared to ask for another as this is the only thing we can fall back on.
There is no public transport here, and I am not well enough to use it anyway, our local supermarket is about 30mins away by car and I don't have enough money to order a home delivery.
I am grateful for any advice at all.

I am sorry to hear that you are in this situation.
I am afraid there is nothing further I can suggest with regard to the lost DLA award.
Based on feedback from the forum, new claims for PIP are being dealt with quite quickly, so you may well have a Decision before the end of April, the only thing I can suggest at this time is to see whether you can get an earlier appointment.
Have you spoken to you Local Authority, based on your post you should be entitled to Housing Benefit if this is applicable, they should be able to help you with any local services such as a voluntary taxi service which may be able to get you to the shops etc.
Other than this all I can suggest is that you prioritise your spending to the essentials.
If any of the B&W members have any ideas, then please feel free to post.

You could consider letting your MP know about the terrible situation you've been left in.
MPs have email so you could send them what you posted on here, it came across as a pretty powerful statement to me.
I don't know whether s/he could do anything about the lost renewal. It's strange how DWP are allowed to assume that you received their letter just because they posted it, but they can refuse to believe anything gets lost on its way to them.
CAB might know of any charities that you could get grants from, say for any big bills. A poor, suggestion, but the only thing I can think of.

Thank you all for your help.
Feeling really despondant now that CAB have washed their hands so to speak.
Will try emailing MP, but difficult to get to library a couple of miles away to be able to read/send emails now that my phone and internet have been cut off.
Have a date for ATOS doc to come out, 1st April, so next Wednesday. Stress and health issues have went through the roof.
To top it all, have been asking for a copy of my initial ATOS doctors report when I was awarded DLA, asked first on 5.2.14 and have asked a further 3 times, recieved it at last but it is incomplete. It has been stapled together and pages have been ripped out? Why would someone do that and why then send it on like that? Have requested another copy but who knows when that will arrive.
My plan was to include it with my PIP application form, but now seems easier to keep it for ATOS doc.

How are they allowed to get away with this?

Whilst we have seen previous assessment reports used to help make PIP Decision there are considerable differences between PIP and ESA and DLA, so I would not expect one to remove the need for an assessment on its own.
