My daughter has a physical medical problem and is on a controlled drug to ease the pain.She was on high rate DLA mobility and DLA medium care. Transfer to PIP has left her on the lowest rate of mobility only. The drugs she has to take are the best for her condition but cause her problems with drowsiness,concentration forgetfulness and other complications.This was all fully explained but there seems to have been no consideration for this at all by the Decision Maker whatsover. We will be asking for Reconsideration and Appeal if need be. I am wondering how others are getting along with PIP / Medication causing extra problems and are the problems drugs cause not being taken fully into consideration as they can vary from person to person and without specific evidence ie from a Dr they are disregarding medication problems.

Hi bc,

I know that with ESA the DWP will not take into account any 'mental 'effects (confusion etc) arising from medication for physical conditions. I am unsure if the situation is the same for PIP. We are short of mod's this evening but I'm sure one of the others will comment when they are able.

PIP does not distinguish between physical and mental health problems in the way that ESA does, but you would still have to show relevance to the Descriptors for these symptoms to be taken into account.

We are a little further down the line with this process which is totally unjust at times as we all know and I feel for people unable to fight their corner and lose out.The whole process as I see it is to lose people at every stage and I'm in no doubt that is the goal.
In my daughters case after DWP decision we asked for HCP report and copy of Atos form from the appointment when she was asked to fill in what extra evidence /information she was handing over. My daughter froze over this document and couldn't complete as was requested due to concentration difficulties with her medication . The HCP seeing the problem said it doesn't matter and not to try but to sign it.This form has not been forwarded to us suprise suprise although HCP report has and makes no mention of what i see as valuable evidential evidence for them and us.I am ex Police and honestly do not trust this whole process whatsoever.
We are now in the process of asking for reconsideration then Tribunal if all fails.
I am sure this has been said many times but I feel people should ask for a copy of HCP report as soon as they get back from the face to face appointment regardless of how they think it went and compare, you may find some suprises (we did). You may well need it anyway and saves time (lots) . I am glad of this site Benefits and Work,besides it's purpose of advice which is invaluable I think it shows whats not right and fair about this unjust system and how it operates I honestly believe underhand when isuits.

Reconsideration got no where despite our argument that the incident (freezing over the paperwork) was not mentioned by HCP in her report and even said no signs of lack of concentration etc. Looks like a Tribunal try as other matters not right either at assessment. I was told I couldn't record in writing as they needed a copy and had no ink in photocopier,Turns out this is not the case Atos on their website say they don't need a copy. I have made a complaint to Atos and informed the DWP as well and still waiting for a copy of the form my daughter was asked to fill in and sign alongwith a page missing from HCP's report. It has been said many times on here ask for HCP report straight after assessment we should all do so as standard practice.It is a way of showing how the assessments can be flawed.
