Hi Rr & P
For the Income Related (IR) ESA means-test, any household income such as a Works Pension (WP) would be offset against any entitlement to IR ESA payments £ for £.
So a WP could cancel out any IR ESA entitlement.
With Contribution Based (CB) ESA, even though it is non means tested, there is an £85/Week disregard rule with respect to receipt of a WP.
Where any amount of WP that exceeds £85/Week would be deducted at a rate of 50% of the excess from any weekly CB ESA entitlement.
e.g. WP = £105/Week = £20 in excess of £85/Week disregard.
50% of £20 excess = £10.
Therefore, in this example, £10 would be deducted from any CB ESA weekly entitlement.
So if your WP weekly payments were high enough, they could cancel out any CB ESA entitlement.

If youre in receipt of ESA and youve always worked you must be on ESA contributions and not Income Related.
I didnt think it was means tested so regardless of you getting a pension or not shouldnt be an issue.
Someone else might tell you different as Im not sure about that.

Hi,
Just wanted to offer support after reading your post. I'm medically retired out of the teaching profession after 23 yrs service due to having multiple sclerosis. I'm in receipt of a pension and I claimed ESA and was put in the support group. I think you should claim for ESA as I don't think having a pension stops you, especially if you've been working and have enough NI contributions. Obviously I don't get the full weekly amount, money is deducted because I do have a pension, but I think you should try to claim ESA because having a pension didn't stop me and others from receiving the benefit, and if you're in the same position it seems you might qualify as well. Don't let you having a pension put you off claiming. Good luck.
