Carers Allowance was created by Dart
I am on DLA high rate care and lower rate mobility and Esa contribution based in the Support group.
I have been meeting with an Advocate to appeal the decision by the local council to withdraw funding for Direct Payments support.
She has suggested that my partner should apply for Carer's Allowance.He has a partime job earning £375 net monthly, some investments and a pension. He doesn't live with me but we spend 2-3 nights and 3-4 days together. He helps me in loads of ways. I have documented day and night care needs. This ( I think) amounts to about 70 hours.
Would he be entitled to apply?i

In principle your partner can claim Carers Allowance for you. They will need to provide 35 hours of care a week although they may accept an average of 35 hours over a longer period. Their income cannot exceed £104 per week after deductions this amount will increase in April, but not everything is accepted as a deduction. Lastly, CA is liable to tax, so your partner will need to inform HMRC so that they can adjust their Tax Code if necessary.
They can make an online claim which potentially can be backdated by up to 3 months. See

Hi,
Thanks for your advice a few weeks ago about my partner claiming cares allowance.Just a few more questions if you don't mind.
My DLA is indefinite so I expect to be invited to claim PIP between October 2015 and 2017, chosen randomlyI understand that my DLA claim is "looked at" while processing the care allowance claim, presumably to check that I am eligible. Although the date for the PIP assessment is meant to be random, might a CA claim trigger an earlier(still post October) than a later one(nearer to 2017). DLA with an additional carer's allowance would cost thhe DWP more than just my DLA and I wonder if that might make a difference to the"random" timing?
Also, I am paranoid about my DLA award being "looked at" in case that causes any problems...Does DWP simply check what my award is, or do they look at it in greater depth?
I don't want to jeopardize my DLA in any way but the money from a Carers Allowance claim would help a lot.
My partner doesn't live with me( he lives an hour away). Would time he spends here overnight be counted towards the 35 hours?I am on higher rate care because I have night time needs when my mental health is particularly bad. He would also be spending 3-4 full days with me also.

The DLA "check" is simply to ensure that you have a suitable award, Medium or High Rate Care and that nobody is already claiming CA for you, I can't see any reason why this would be classed as a Change of Circumstances in regard to our DLA and therefore trigger an early invitation, further, the CA claim is in your partners name not yours.
As you are receiving HRC, it is accepted that you have care needs over night, so I can see no reason why this cannot be included in the 35 hours required to claim CA. Your partner should be prepared to explain the care that they provide during this time, but it would be extraordinarily unusual for them to be asked about this.
