My History of being changed from ICB to ESA, query was created by redgt9
Hi, first thank you if you can answer me. I was taken out of work approx 20 years ago some physical problems but as time went by it also became mentally.
Well going back to 2012 I was automatically placed into a WRAG ESA with 365 days claim, I did not understand any of this.
I had telephone calls from the Jobcentre asking me could I come to them for a meeting so I said no (I suffer with bad Agoraphobia) and they were great and said they understand how I feel and will telephone me in six months time.
When I got close to the 365 says were up, I was told I will no longer get paid after that date.
I did not understand this, I felt I was covered similar to my old benefit ICB but all of a sudden I was close to getting no income.
I panicked and tried to contact anyone and everyone for some help but got know where so I decided to give up and kill myself, ok some of you might think drama queen but consider this, I had help offered me but only if I can go to them Agoraphobia stopped me dead in my tracks.
Now going back to my long winded question, after my change from ICB to ESA in 2012 which I was placed into WRAG ESA and that was about to expire I was then placed into a Support Group ESA am I allowed to have another 365 days if they decide to place me back into a WRAG ?

Claimants only have one period of 365 days receiving ESA(CB) while not in the Support Group during any single, continuous claim of ESA.
As you have already spent time in the WRAG this will count against any new placement in the group, if you in fact used all of the 365 days during the first time you were in the group then will have zero days left. See
12 Month Limit for ESA(CB)
However, this only applies to ESA(CB), if you are also eligible for Income Related ESA then payments will continue beyond the 365 days as long as you continue to qualify for ESA. ESA(IR) is dependant on your household income, your savings and assets, and any hours that a partner works. See
Asset rule for ESA(IR)
24 hour work rule for ESA(IR)
It may be worth checking whether you are eligible for ESA(IR) now as being in the Support Group entitles you to the Enhanced Disability Premium which would add £15.5/week to your payments. If you are then it would be as a top-up to your current ESA(CB).
You can request an ESA3 from the DWP office that deals with your claim which collects the information the DWP need to check your ESA(IR) eligibility.
