A tribunal Decision would by definition only be able to refer to your condition as it was before the deterioration that prompted the request for re-assessment and would therefore (in this situation) be of no value to you, you need to provide documented evidence of a deterioration in your conditions.

Mr Kim Catherall wrote: That could well be the case. Also, they would have my tribunal appeal decision, would that be taken into account.

Hello Mrs Hurtyback
I am prompted to contribute because I think that people should never agree to a face2face without having completed and sent a ESA50 first.
Under ESA guidelines, this form is a fundamental evidential document.
It happened that when I was transferred from IB to ESA and had completed ESA50, the form never got to the HCP. He showed me an empty file at the interview!!
After contacting B&W back in early 2012 and you gave the references above,. I complained, and was put in the Support Group, presumably after someone got round to skimming it!!

I did send an ESA50 in, last April. It was the printable one you recommended, I found it on my pc. Thank goodness for it, I can now see what I said and can prepare accordingly.

If your ESA50 was returned in April of last year, then you should consider providing up to date information if the effects of your conditions have changed. If you do, then send a copy to the assessment centre that you have been invited to attend, we recommend a copy be sent to the DWP office dealing with your claim, marked for the attention of the Decision Maker and finally take a copy to the assessment and ask the assessor to read it and include it your file before continuing with the assessment.

You were spot on Gordon.
If I hadn't joined B&W I wouldn't have known about that and it made a big difference.
At yesterdays medical the HCP read my updated ESA50. She then left the room for several minutes. Upon her return she stated that she couldn't assess me as I'd since developed a neurological condition and would have to be assessed by a doctor.
I've always been of the opinion that a doctor should carry out the assessment as he/she will have a better understanding of how your condition impacts on you.
I think that I should also re-visit my GP. His support letter was also from last April and as the neurological condition was diagnosed last November, there's no mention of it in his letter?
