ESA Appeal Submissions

I rang first thing this morning,the person i spoke to this time said the complete opposite of what i was told on tues, i am still on JSA ,so they said they would pass my details on to the processing department.Two hours later i got a call from processing dept ,they said they had not got my letter or fit note and that it may be stuck somewhere in the backlog.They said they were now going to close my JSA claim and reinstate ESA .They said this would be done before my next JSA payment is due so i would not be without money.I asked if it would be confirmed in a letter and was told yes.Unfortunately i didnt get the name of the person.

This is not our understanding of the procedures that the DWP should be using, once the DWP receive notification from the Tribunal Service of the request for appeal and the claimant informs them that they want to be put on the ESA Assessment rate (including a Fit Note), then the DWP should handle everything from their.
There should be no requirement for the claimant to cancel their JSA claim in order to re-claim ESA.
Whilst it is not impossible that that the DWP are doing this deliberately I think it far more likely that it simply the result of incompetence and a lack of training.
