after fighting for higher rate mobility for my disabled son I at last won an appeal on 17thDecember2015, it was won on his Mental Disabilities and a breakdown in May 2010, It was given from 5/5/2010 for an indefinite time, however since then I have been messed about by the dla and even had to send them a copy of the decision, even though they had a representative at the hearing who was given the same result letter, now they have sent it back to the Judge for verification
and we are still waiting, after 9wks, I think they are trying to get out of paying my son his backpay
does anyone know if their is a limit on back payments? I hope you can help

Hi KW,

I will refer you back to my response to your previous related query : Here.

If the appeal was regarding an adverse DLA decision made on 05/05/10, then as the Tribunal's decision is a "re-making" of that adverse decision, any back pay owed should be paid from that date.

It is quite a common occurance for appellants to receive large sums of back pay after a successful appeal due to the long periods that are sometimes involved in an appeal receiving a hearing.

Have the DWP requested a written Statement of Reasons with a view to seeking leave to appeal to The UTT as they feel that The Tribunal have erred in law in coming to their decision ?

If so, then you will not receive any back pay until this has been resolved in your favour.

Are they simply dragging their feet in challenging the amount of back payment owed?
