Is it likely or unlikely that a 'personally' recorded interview for PIP would be permissible as evidence at a tribunal hearing to highlight 'glaring' assessment inaccuracies in the assessors report filed to the DWP. The dialogue is highly legible. It should be noted that the recording was for my own personal records and was not indicated to the assessor at the time of the assessment.

Tribunals can admit whatever evidence they believe is reasonable in connection with a hearing, however, you need to bear in mind that most hearings are approximately 40-50 minutes and are primarily concerned with whether you meet the benefit criteria or not, so there is little opportunity for this type of evidence to be heard.

For it to be considered you would need to make it available to the Tribunal in advance of the hearing, it is likely that they will require a full transcript of the recording, you cannot pick and choose the excerpts that you wish them to review, as a result you should also consider whether anything on the recording is to your disadvantage as the DWP will be sent a copy of all of the information

Even if you submit the recording as evidence the panel are not required to examine it during the hearing, they may decide that they do not need to do so in order to make a Decision.

It is likely that information on this matter is not publicly available, but I am only aware of one occasion in the last five years where a Tribunal has heard such evidence and there were special circumstances surrounding this case.
