ESA Tribunal - how much notice do you get? was created by Angelica
I've been waiting for an ESA tribunal for nearly 2 years! (Contribution based, so haven't had any money for a long time and know I won't be getting any either. It's mostly a matter of principle as the medical report was full of lies/half truths)
Just had a letter to say that I would be contacted in the "near future"
Does anyone know 1) Do they contact you by letter or telephone?
2) How much notice do they give you and is there a possibility of choosing a
date if the first one you are offered is difficult for you?

Nothing on this board constitutes legal advice - always consult a professional about specific problems

In case you are not aware, your real name appears to be showing in the forum, if you want to change this then follow the instructions in the following FAQ
My full name is showing, how can I stop it?
You should receive a minimum of two weeks written notice although this will include postage time.
If there are dates that you cannot attend on then you need to contact the Tribunal Service to make them aware of them as it is not usually possibly to re-arrange a hearing date once it has been booked.

Thanks Gordon. I actually received a letter today, after I'd posted this, with a form to fill in. Don't think I have any significant extra evidence to send in, have just had continuing physio (very sporadic because of NHS cuts) and yearly monitoring at the orthopaedic hospital, nothing they can do about the pain!
Do you think it's worth getting copies of appointment letters for these? It's not much to show!

They are evidence of on-going treatment, however the Tribunal are unable to take account of information that post dates the Decision on your claim unless you can show that it is still relevant to that date.
Have you considered looking at your medical records at your GP Practice, most Consultants will write to the GP after each visit and these will be stored at your practice.
Requesting your medical records
