ESA(ir) DLA

I have looked through some of the site and gotten some form of answers to what i am going to ask, i am just looking for some clarity.

I get esa ir, dla, lrm and mrc. i am due a renewal esa form as i was given tilll dec 2014, so am expecting one any time.

However i am due a substantial inheritance in the next few weeks, enough to keep me going for 2/3 years, I will contact housing and council tax when it deposits into my bank, and am i right in thinking it wont effect my dla?

My queries are,
can i just ring and inform them that i will no longer be entiltled to esa for a few years or would i have to fill in that long change of circumstance form, plus would i actually have to tell them on the phone or in writing exactly what i will be recieving, as i dont think it would be any of their business and do not want to telll the minions, as it willl be flagged anyway and them at top will know,, Would my claim stay open, as i could not go through all that again, forms etc, the stress as we all know is intense and makes you feel even worse than you already are. When my money drops in a couple years would it be straitforward to continue, as i am not going to get better, my illness is progressive, amongst other problems, its just that i am getting myself worked up thinking about it, stupid i know.

Hi k,

Although it would seem that you are not a new member, it does seem that this your first post on the forum, Welcome !!! :)

DLA is a non means tested "Benefit" so any monies that you have, no matter how much, will not affect your payments of DLA.

Likewise, when you are eventually invited to claim PIP, if you are successful, as with DLA there is no limit on any monies that you may have.

As you may know, capital, assets and saving in excess of £16.000 will preclude you from any IR ESA payments, see : Asset rule for ESA(IR)

However, if your monies depreciate below that amount in the future, there will be nothing to stop you being paid IR ESA once more.

If you are considering having to do this in the future, it would be advisable to keep all invoices and receipts of anything that you may buy, and some type of record of your expenditure.

The reason for this is that the DWP will deem that the monies that you have should last a certain amount of time, so the information that you may choose to keep as mentioned above would be proof that you have not squirreled the money away somewhere in an effort to deliberately deprive yourself of capital to gain future entitlement to IR ESA payments.

You can keep your ESA claim active, and this will still involve periodic reassessments. (ESA50's, etc)

The advantage of this is that you will still receive your NI Credits (Stamps) towards your : State Pension.

As you will see, you need at least 30 years NI Credits/NI Contributions.

Even though you may be placed into The WRAG in a future reassessment, you would not have to take part in any Work Related Activity (WRA) whilst you are receiving NI Credits only. (No IR ESA payments)

Just as you would not have to take part in any WRA if you are placed into The SG.

So you have the two scenarios, keep your ESA claim open to receive NI Credits only, or completely close your ESA Claim and receive no NI Credits.

If you do decide to close your ESA Claim, do not simply let it lapse by not returning your ESA50 etc, this may cause problems in the future.

Close it formally in writing.

It is your responsibility to inform ESA, HB, or CT Departments formally of your inheritance, and I would definitely do so in writing so that you have a paper trail :

Sending Documents to the DWP or ATOS

As DLA is non means tested, you would not have to inform them.

I hope you enjoy your inheritance, whatever you decide with your ESA Claim !! :)

Hi Bro58,

I don't want to muddy the waters regarding advice already given, but although (poster 'Kath') only refers that she receives IR ESA, what if this is made up of CB ESA and IR ESA top up?

Would 'Kath' not be entitled to CB ESA part of payment and only lose the IR ESA part?

(If I am mistaken please delete this post before being readable to others).

Hi f1969,

I am on "overtime" now !!! :laugh: :laugh:

From k's post she only mentions IR ESA.

However, you are correct, if any part of her ESA is CB ESA, this would not be means tested, and she would retain entitlement to payment of any CB ESA that she was receiving.

She would still need to inform them in writing about the inheritance.

many thanks, it has answered a few questions, i will keep the claim open, as will at some point have to claim again. or rather carry on and fill in forms etc, as dont think i will have enough ni credits, and i did mean to mention i was in esa, ir support group.
