PIP RE-CONSIDERATION was created by ladybear1
:(

I have severe arthritis in both knees, angina and a hiatus hernia.

I have scored 0 points for my assessment and am planning to appeal inwriting. My GP has informed me he no longer writes medical reports since PIP came about in 2014 and I am to go for yet another x.ray and use that report as evidence instead.

Is this usual?

Hi,

Welcome to Benefits and Work :)

If your forum name is also your real name, you may wish to change it to maintain some anonymity.

This can be done quite easily by following the instructions on this FAQ :

My full name is showing, how can I stop it?

It is not unusual for a G.P. to refuse to provide supporting written evidence for their patients to help with benefit claims and appeal.

They are not contractually obliged to do so, even if you offer to pay.

In saying that, this does not happen across the board and some G.P. will still offer written support, free of charge.

So it is dependent on the policy of each G.P. practice, and in some cases, down to whether an individual G.P. is willing to do so.

Have you thought of trying another G.P. within the practice ?

Failing that, you can make a Subject Access Request (SAR) for copies of all your G.P. records under The Data Protection Act 1998 (DPA 1998) at your G.P. reception.

The G.P. does not even have to be consulted, and they cannot refuse, although there will be a charge :

Requesting your medical records

Charging for medical records

Your first step in challenging the 0 points PIP Decision is to make a formal written request for a Mandatory Reconsideration. (MR)

This must be received by the DWP no later than one month after the date of the PIP Decision Notice letter that you received.

Sending Documents to the DWP or ATOS

I responded to another member in a similar situation to you earlier today : Here.

You should find the links to the information that I have provided there helpful.

Please reply to this topic if you have any further queries and we will do our best to help.
