I got my letter today telling me that I have been put in work related activity group this morning, I understand that it is contribution based and that after a year it finishes ( my husbands works) . I want to appeal to try and try to get into the support group, I haven't had a nights sleep since the 3 December when I had to have my medical, I have downloaded the guides and want to ask before I send a letter to ask for a mandatory reconsideration I haven't seen the Atos report do I send the letter out asking for the reconsideration without knowing what atos has put down? . I have a month to do this but knowing what the DWP are like I can't see them sending a copy out in time for me to check it, do I send the request in and then ask for a copy, I'm so wound up at the moment I can't think straight.

As an addition to Gordon's comments,

The important issue with The MR request is to make it clear, how and why you feel that you should have been placed into The Support Group (SG) at the time of the adverse WRAG award.

You can request the ESA85 Medical Report over the phone as advised. For information on other documentation that you may wish to request in writing, have a read though : This Post.

Even though the post is with regards to an SG award, the same would apply for a WRAG award and issuing a SAR, etc.

As the DWP have 40 calendar days to comply with a SAR, this is one of the reasons why you should not delay in making your written request for an MR as a separate issue, in a separate envelope.

You can comment within The MR Request that you have issued a SAR for the ESA documentation, and that you will provide any other relevant feedback when you receive the documentation.

Remember, to qualify for the SG, you must show that you fulfilled at least one of : The SG (LCWRA)Schedule 3 Descriptors, or if non of those, via : ESA Reg 35 for entry to The SG (LCWRA)

I have been looking at the guides and I think I may qualify for support group as my husband has to help me get out of bed , get dressed and my leg gives way under me without warning, I am also waiting for appointment to see specialist as I have discs press in g on nerves in my spine, there are days I am crawling on the floor in pain am also on antidepressants because I don't sleep very well, but its the walking that I have the most trouble with I can't go anywhere without someone with me in case I fall. My husband was with me in the medical and explained how much he has to do for me but I don't think the person doing the medical cared, all they seemed bothered about was filling in the forms and getting us out. I am on the highest rate DLA for mobility and know that this is changing am dreading more form filling. What happens if I just stay on wrag until the end of the award, do I reapply or is that it nothing, so confused.

If you do not go through with The MR/Appeal of the WRAG award, besides your CB ESA payments ceasing after 365 days, you will be reassessed at the end of the recommended period. (The Prognosis)

This will involve filling in a new ESA50 etc, even if you have exhausted your 365 days of CB ESA payments in the mean time.

Just to point out that for HR DLA Mobility, it is purely a "Walking" test.

With The ESA "Mobilising" Activity/Descriptor (1), not only does it assess your ability to "Walk" the requisite distance with or without a walking stick or other such aid, it also assesses whether you could self propel a manual wheelchair unaided over the same distance, even if you have never owned, used or been advised to use a manual wheelchair.
