ESA Received -What if ATOS decide I am ineligible? was created by Rachel Brown
I have been receiving ESA for about 7 weeks. I am waiting for an ATOS assessment. If ATOS decide I am fit for work, what is my eligibility/entitlement to the monies already paid to me?
If DWP require me to repay the money, what are the rules about this?
Where can I find more information about this?

Welcome to Benefits and Work
If your forum name is also your real name, you may wish to change it to maintain some anonymity.
This can be done quite easily by following the instructions on this FAQ :
My full name is showing, how can I stop it?
If you are found fit for work, there will be no requirement to pay any monies back to The DWP.
I don't know whether you have received, filled in and returned an ESA50 Questionnaire yet, if you haven't, you may wish to consider :

Sending Documents to the DWP or ATOS
If you have, it is not a definite that you will have to attend a face to face (f2f) "medical" with ATOS.
If they feel that you have provided enough information, they can make a recommendation for The WRAG or Support Group (SG) of ESA on the paper evidence alone.
Once a decision has been made, if you are placed into The WRAG or The SG, the extra monies owed due to The WRA Component or The SG Component will be backdated to the start of week 14 of your claim.
I must pre-warn you, that even though you may receive The ESA50 quite quickly, that there are huge backlogs in The ESA Claims process, and we have heard from members who have been on The Assessment Phase of ESA, without receiving a decision for 12 months or more.
