i gifted a property to my son for no money 1 year later i became ill and am unable to work resulting in me having to claim contribution based employment and support allowance will the gifting of one of one of my properties effect my entitlement to contribution based esa i have been told that only occupational pensions will effect my payments of contribution based esa and support group which i have been placed in the reason i am posting this question is to know if by gifting a property to my son without any money being charged for the property will it be classed as notional income although at the time of gifting the property i had no idea i would have to give up my work due to ill health at a later date thanks for your thoughts on this issue miner

Contribution Based ESA is not affected by income (with the exception on pensions) and any savings and assets that you have, however, you need to be aware that if you are at anytime moved out of the Support Group then you will only have entitlement to ESA(CB) for 365 days, assuming that you have not already spent any time outside of the SG. Should this happen then the property may be considered as Notional Capital in regard to any Income Related ESA that you might be eligible for.
