Hi all
This is my first time on any forum so please bear with.
I have been on DLA since 1989 for higher rate mobility In February of this year my DLA run out and my claim was refused. Cutting a long story short I went to court for an appeal in March. The judge adjourned the appeal stating he wanted more medical evidence. A doctor from atos came out to see me I have received the form she filled in she states that in her opinion I can walk 100 metres which I can't. The next court date is the 18th of November, I suffer with a form of Agoraphobia and I have done for the last 6 months, I am very nervous about going to court. My question is will it make any difference to the outcome if I attend or not.

All I can provide you with is the statistics for hearings attended and those that are not, you are four times more likely to win your appeal if you attend than if you do not, but please do not assume that you cannot win if you do not attend as it is certainly possible.
If you opt not to, then it is still possible that the panel will still ask you attend, this will be because they have questions that they cannot easily answer from the evidence available, it may be to your advantage to attend if this happens and are able to do so.
Either way you can make any comments that you wish on the medical report that you have just received, just make sure everything that you want to say is with the Tribunal Service before you notify them that you want a paper hearing, as you will receive no further notice in regard to a hearing, just the Decision when it is made.
