Hallo Would you be able to advise in the case of a Full UK British Born National Adult Passport holder currently living in the UK
entirely off benefits but, not of Pension Age, moving abroad(possibly Europe possibly outside Europe) for x amount of years and then returning to live in the UK are their rights to claim benefit affected upon their return?
Would there be a certain number of years after which their Uk Citizenship rights such as NHS access right to claim ESA,JSA,DLA,PIP when domiciled again in The UK but still under pension age would be affected ie.lapse because they had not maintained residence in the UK?

UK citizens returning to the UK after a prolonged period abroad may have to pass the Habitual Residence Test, whether this is required is currently on a case by case basis, given the current political dialogue it is likely that the rules will become stricter in the future, the following has an overview of the HRT.
