Dear benefits and work team,

I’m wondering if you can answer a question for me, my son who is on low rate mobility has had a letter asking him to go in for a medical in late August about his claim. This is the only benefit he is claiming as his wife works so his wrag (ESA) got stopped.

My son thought his dla was up for renewal in 2016, he has been asked to bring in any medical reports he has that he wishes them to see. I’m wondering if this is to ask him if he wishes to claim PIP. He has not had a phone call asking him if he wishes to claim PIP.

My second question is - can they ask him to fill out the form there and then?

This all seems a little strange as this letter came from atos and we live in South Wales which I didn’t think was a atos assessment area any more.

It cannot be for PIP, you have to be invited to claim PIP and you cannot be assessed for PIP without the completion of a claim form.

It is far more likely that it is in connection with his ESA or to be more precise Limited Capability for Work.

I assume that he previously received ESA(CB) and his payments were stopped because of the 365 day rule, this being the case he continues to receive NI Credits that count towards a full State Pension, these are only payable while the claimant maintains their LCW and as a result claimants in this situation are still liable to regular re-assessment.

Your son should have received an ESA50 as part of the process if there is still time for him to complete one it may be worth his doing so as should he placed in the Support Group then his ESA(CB) payments will be re-instated.
