Did your partner ever officially close his ESA claim or is he still receiving NI credits? If he did close his claim then he will not be able to reclaim due to not meeting the criteria for either contributory or income-related ESA. If he is still getting NI credits then he would be eligible for payment if he were put into the Support group at any stage in the future.
