Hi all,

I have been on income support due to ill health for nearly 10 years now. However, I have just discovered I should have been on incapacity benefit due being under 20 at the time I applied and so not having to have 3 years NI contributions. I did not know about this rule when I applied for incapacity benefit when in hospital and so did not know to appeal. Is it way way too late to get this corrected? I only ask as I am worried that if I inherit some money or move in with someone who is earning I shall lose my income when I shouldn't have done.

I think it highly unlikely that you can address this.

The absolute limit for appeals is 13 months, I am afraid that your not being aware of the requirements would not be reason for the DWP to re-visit the Decision.

You could speak to a trained advisor to see whether they can think of any way to back date the claim, but I would be surprised if they do not agree with the above, do an internet search for "welfare advice" with your postcode, town, or county.
