I am the main carer for my 25 year old daughter and I claim carers allowance however it is taken into account as I claim Income support for myself they take the carer amount from my Income support and I get a Carer premium instead.

My question is: My Daughter has lived on her own in my area for 4 years now and I mainly support her via telephone and have to be on hand should I be needed, I am also the person who deals with all her benefits, bills etc. as she has Mental Health problems.

She wants to move to a different part of the country which is approximately 2 hours away from me by car but I will still be her main carer and still have to be on hand even though I will have to travel further to see her.

Question:

Am I still entitled to claim Carers Allowance and Income Support even though I live in a different area and is she entitled to Housing Benefit if she shares accommodation with a member of our family, she also gets High Care DLA and Low Care Mobility Allowance?

To receive Carers Allowance you must be "regularly and substantially engaged in caring" for a minimum of 35 hours care a week for your daughter.

If you can do this after she moves and can show that you do this if asked, then you should still be able to claim CA, however, if you cannot do this or as importantly, show that you do it then your current claim may no longer be valid. Time spent caring can be averaged so as example; 40 hours one week and 30 the next, but the more divergent the figures the less likely they are to be averaged, so 65 hours one week and 5 the next is more likely to result in the 5 hour week not being payable.

She may be eligible for Housing Benefit but I suspect that it will depend on the arrangement she has with her relation and whether her name appears on the rent agreement for the property.
