Can you get attendance allowance if you are in residential care?

I believe that depends on how the care is being funded. If the claimant is funding the care then AA can be paid, if the care is being funded by the state then AA cannot be paid. I don't know what happens in cases where the state pays part and this is topped up by the claimant, maybe one of my mod colleagues will comment.

Whilst I cannot find a definitive source I don't think AA would be payable even with where the claimant is part funded as the Local Authority or NHS payment would be at least as much as any AA would be.
