It sounds as if your GP is not going to be helpful, having made a Decision, the DWP will not now write to them for additional information, a Tribunal might, but even them it is unlikely to happen before you attend a hearing.

As to their commenting on your daily activities, I would not expect them to be able to do so in detail but they ought to be able to state whether they believe your limitations are consistent with your conditions.

As an alternative you can request a copy of your medical records, this will give you access to any reports and letters that have been written in regard to your conditions by any HCP you have seen.

Charging for medical records

As to responding to the Decision I would suggest you phrase an answer to each of the 12 Descriptors using our Guide, using content from the favourable report to support your statements and countering, as necessary, the content from the negative report.

Cheers Gordon. I wouldn't say my GP will be unhelpful per se; he is quite open but also won't step beyond any boundaries that would affect his registration. However, I will speak to them tomorrow regarding your advice about my condition being consistent with my limitations.

I will get to work on my written submission for my appeal and keep you all updated over the coming weeks. Thanks again!

Your GP is perfectly entitled to write a letter or report in your favour which wouldn't breach his GMC registration.

The three panel members will not meet up as a Tribunal until the date of the hearing, so cannot ask for a GP report until that date. They could also, if they saw fit ask for a further HCP report.
