I have been on long term IB since winning a case against the old DSS in 1997. Last year I received a form to fill in for transfer to ESA which had to be back by August, now one year on I have not heard a thing. Over the last three months I have become even more ill, having blood clots in my arm and now a lifelong warfarin patient. On top of this I have been diagnosed with DISH (Diffuse Idiopathic Skeletal Hyperostosis) the top of my spine has calcified I can no longer turn my neck and even with painkillers I am in constant pain on the whole of my back.
I am not sure whether to let sleeping dogs lie, contact them to update my situation, who do I actually contact if I do?
My benefits went up in April and they are still being referred to as Incapacity benefit, does having previously won a case against them alter things?
I have an inoperable cerebral aneurysm, the joke being I won my case on my deafness!

Welcome to the forum. On the assumption that you are also new to the site, this FAQ should help you find your way around.

I am sorry that you are going through this, I'm sure it's the last thing you need on top of your health problems :(

We are hearing from many claimants who have waited far too long for ESA assessment/decision, even getting one's MP involved seems ineffective in getting things moving.

You can send details of your new/worsened condition in right up to the date of the assessment, whenever that might be. We suggest that you send a copy to both DWP and ATOS. Your having won a case against them in the past will have no bearing on your current situation.

If you new conditions effect your limitations as stated on the ESA50 that you completed last year then it is important that you tell ATOS and the DWP about them, if you do not then they cannot be considered in any assessment of your claim and you may not then receive the award that you are entitled to.

The first thing to do is to contact ATOS to find out what is happening with your claim.

You will also need to find out which ATOS office is dealing with your claim so that you can write to them with details of your new conditions, these should be detailed in reference to the ESA Descriptors for them to be of relevance.

We recommend also sending a copy of this information to your local DWP office, there address should be on any letters you have received in regard your IB. You should also take a copy to any assessment that ATOS might arrange as part of your ESA transfer.

There are considerable delays in the ESA assessment process at the moment and is not unusual for claimants to be waiting a year for an appointment with ATOS.
