Questions around closing of ESA(CB)Claim. was created by James
A number of questions coming up to the imminent expiry of 1 years ESA(CB).
The claim will be closed and I will have little option but to seek work even though not really well enough.
Do not intend to seek ESA(IR) as may be pressurised onto the work programme,repeatedly re-assessed ad infinitum plus sanctioned all the time.
When the claim is mothballed can it be taken into account if a fresh ESA claim is applied for sometime in the future-say maybe after 2 years work?
Is the current standstill in Medicals from IB to ESA also affecting the re-assessments of already transferred ESA Claimants?ie the periodic Medicals whilst on ESA?
Do I remember reading that you can just get your NI Credits paid and nothing else just by being on sanctioned ESA(IR)interminably,with little risk of Medicals due to standstill(if applicable)?
These are the questions at the moment.
After all Ive been through on IB for many years its a huge lifestyle shift to have my ESA(CB)claim closed and will leave me without income or any skill/trade/occupation
elderly in a young competitive tough job market to survive until pension age kicks in.

Once a new claim for ESA(CB) is separated by more than 12 weeks from the previous claim it is treated as separate in all aspects, however, any sanctions from the original claim that are still outstanding may well be transferable to the new claim as a sanction is only removed once the failed requirement that caused the sanction is satisfied.
There are two aspects to the current backlogs, re-assessments are currently suspended and those assessments that are still being carried out are subject to considerable delay, current reports put it at 12 months.
NI Credits are paid while a claimant is receiving ESA, irrelevant of type, you should also remember that the DWP can only sanction the Personal Allowance not the WRAG Component.
