Unfit for work for more than 2 years? was created by Deansandra
Hi all
I have been placed in the support group which I understand only last for a year and then you are kicked off it yet the report says that I will not be fit for work in the long term this being more than 2 years as I have complex needs.

Q: is this not a contradiction? What do I do after 12 months?

Thank you in anticipation of a response

Dean.

Hi D,

Many congratulations on being placed into The SG !!! :)

From your previous posts : Here, it would seem that this is as the result of a successful MR/Appeal.

I think that you may be getting mixed up with the "12 Months Rule"

The maximum recommended period before an ESA award should be reassessed (The prognosis) is 3 years.

See : How often will I be reviewed

There is a 365 days rule to payment of Contribution Based (CB) ESA only, in The WRAG, or at The Assessment Rate, (Not in The SG) no matter how long the prognosis of the WRAG award is.

There is no such rule for ESA recipients in The SG, whether they are in receipt of CB ESA, Income Related (IR) ESA, or both.

You will continue to receive payments as a result of The SG award, for as long as you remain in The SG.

As you are in The SG you may also be entitled to : ESA Premiums

You would only be entitled to these "Premiums" if you could pass the means test for entitlement to IR ESA.

All "Premiums" are paid in the form of IR ESA top ups, so no entitlement to IR ESA = No payment of Premiums.

If you have not already been financially assessed, then you would have to request an ESA 3 Form from the DWP. This would be used to capture your financial details to assess your entitlement to IR ESA.

If any part of your current ESA payments is IR ESA, then you should be getting the Enhanced Disability Premium. (EDP)

As you will see from the : ESA Premiums link, being in receipt of MR/HR Care of DLA or PIP Daily Living Component may also entitle you to payment of other "Premiums".
