Hi to everyone I recently (April 2014) had Atos medical and DWP have put me in WRAG. As I have high rate mobility and middle rate care I feel I should be in Support group. I am virtually unable to walk and cannot sit or stand for more than 20 minuets on either count. I rang Esa and they said I have to write requesting a Mandatory reconsideration. I shall enclose photocopy of my Dla award notice. I just wondered what else I can put in the letter to sway the decision to Support group. I do not feel safe when out alone and I am under the pyschiatrist at the hospital apparently front and back of brain is ok it is something in the temple region. I have limited use of left arm and arthritis in my knees. Any advice would be most welcome as I feel I would be able to help others in the same situation...Steve aged 59

You can phone and request a Mandatory Reconsideration but we do suggest that you follow this up in writing. You can submit an extra evidence you have to back up your contention that you should be in the Support Group but you should be aware that this will delay the process. You also need to feel sure that your current award is safe as the Decision Maker (and Tribunal, if things get that far) can downgrade your award as well as upgrade it.

Is there any risk to challenging a decision?

The difference between the mobility descriptors of ESA and DLA is that ESA looks at 'mobilisation' rather than just walking. If your upper limb problem would prevent you from self-propelling a wheelchair then you should make this clear.

I'm afraid that you will still have to participate in Work Related Activity, if 'invited' to do so, although this should take into account your limitations. If you are on Contributory ESA then payment in WRAG is limited to 365 days, unless you are also eligible for income-related benefit, appealing will not affect this unless you are allocated to the Support Group before your time is up.

After requesting a mandatory consideration DWP has now moved me into the support group. I could not have done it without Benefits and Work many thanks to you all.
