Transfer to ESA update, I am confused. was created by JeanCannon
Hi
5 weeks ago I posted my ESA50 form and sent info from specialists etc.
Last week my GP rang me to say she had received a form to fill in also from Atos.
Anyway today I received a letter from Jobcentre plus saying
" We advised you that you were due to be assessed to see if you qualified for ESA.
We are now writing to advise you that you are no longer going to be assessed for ESA at this time and that no decision will now be made as to whether or not you would have qualified. You do not have to take any action.
Please ignore our earlier letters and accept our apologies for any confusion this may have caused you"
There is more to the letter, but this is the main part

Nothing on this board constitutes legal advice - always consult a professional about specific problems

This is the first time that we have seen such a letter so I have to admit that I am a little confused as well, it seems to be implying that they intend to leave you on IB for the foreseeable future.
Are you close to retirement age?
This only makes sense if you are and they are going to leave you on IB until you retire, if you are not, then it seems likely to me that you will have to go through the process again later in the year, in this case I would be tempted to ring the DWP for a more detailed explanation.

I am nearly 55 nowhere near retirement age.
The letter goes on to say that I am still entitled to NI credits and these will continue to be credited

Is your current IB in payment or do you only receive NI Credits?

OK that makes much more sense now, although I am still a bit surprised that they have not gone ahead with the assessment, ESA claimants who are only receiving NI Credits are being regularly assessed, or at least were before the deferral of re-assessments.
