Hi, I am new to the site and would like some help please?
My esa is due to finish in june, I have claimed for a number of years but after tribunal this time I was put into work related group instead of support group.
I want to tell them my condition has worsened, do I do this by letter or special form? and how do I word things
I have recently had x rays and have arthritus in my spine worsening my condition and mobility.
I have been given antidepressants I am suicidal and I am suffering from an abusive partner- mental not physical.
I cannot claim income related ESA because my husbsnd has a pension and I am still living with him at the moment.
Any advice please? many thanks Jean

To be placed in the Support Group you need to meet one of the SG Descriptors or the Exceptional Circumstances Regulation, see

Qualifying for the Support Group

If this is the case then you can request a re-assessment of your claim (supersession) due to a deterioration of your claim, you need to write to the DWP office that normally deals with you claim making the request.

I would expect you to have to complete a new ESA50 and to also be asked to attend a new face to face assessment.

The burden of proof lies with you to show that you meet the SG criteria, so you will need to provide medical evidence that supports the change and this must be new i.e. not previously submitted.

I am afraid that you request will not stop the time limiting of your ESA(CB) but if you are successful then it should be backdated to the date that you make the request, you need to be aware that at the moment re-assessments are regularly taking 12 months to be completed.

In case you are not aware, it seems that your username might be your real name. If you wish to change this, in order to maintain an element of anonymity, you can do so by following the advice in this FAQ.

ESA is actually an indefinite award and many routine reassessments have been delayed. If you prefer not to wait for DWP to initiate reassessment you can write and ask for a 'supersession' on the grounds that your condition has worsened. This will probably trigger another ESA50 +/- a face2face assessment. The onus will be on you to show that 1) Your condition has worsened(or you have a new condition) since the previous decision and 2) You now meet at least one of the Support Group descriptors.

Qualifying for the Support Group

It would be worth having a look at our ESA guides so that you are prepared when the forms arrive, you can even make a start on the interactive on-line form if you wish. You can also use the time by starting to get together evidence to back your claim.
