Hi everyone
I was awarded PIP last Friday at the high rate of mobility but only 6 points in care. I am going to ask for mandatory reconsideration. I only have benefit of the decision makers award letter justification, the ATOS report has yet to be sent to me despite asking for it 4 weeks ago.

My question is please
Do I need to write a detailed letter with points of where they got it wrong? Or will a simple template do like the one on this site?

Should I offer the DWP decision maker a complete transcription of the ATOS assessment that I've done or leave it til tribunal if DWP want it to go down that route?

Congratulations on attaining the enhanced rate of PIP Mobility !! :cheer:

You have one month from the date of the PIP Decision Notice letter to make a request for a Mandatory Reconsideration (MR)

This request can be made verbally over the phone. However, I would strongly advise that you back up any verbal request in writing, making it absolutely clear that you are making a formal request for a Mandatory Reconsideration of the adverse PIP Daily Living decision.

Make it clear that you are only challenging the Daily Living Component decision.

You can use our template letter taking the above into account.

If you cannot obtain the medical report within the one month limit, you can make a SAR, and make comment in the MR request that you have issued a SAR, and will make further relevant comments when you receive the documentation. :

I would send any SAR in its own envelope, FAO The DWP Data Controller at the office that administers your benefit.

Write DPA 1998 SAR in top, left, front corner.

Although it may help to point out any discrepancies in the medical report, the important issue is to reiterate how and why you should be awarded enough points to qualify for the Standard/Enhanced Daily Living Award.

You are in the same boat as me, got mobility not care, put in my reconsideration with the help of the council welfare rights 2 weeks ago tomorrow but haven't heard anything since.

I haven't had any kind of call since my ATOS assessment which is annoying as the HP totally misrepresented me .
