hi guys

wonder if you could help me, All the mods that I have seen on this site say that if you are only on con esa ni credits, you will not be required to take part in wfis any more.
But are you still required to take part in wra, and if not is it in the regs anywhere. I hope my question makes sence.

Hi Derek,

No, you cannot be required to take place in WRA if you are not being paid to do so.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Thanks mrs hurtyback

I was worried that if I didn't comply, that I would lose my ni credits or my pip.
At the moment I am only receiving ni credits, but I am awaiting a decision on my last esa form, I have been waiting 10 mouths so far. thanks again to all the mods.

Hi d,

Just to reiterate MHB's sound advice, and in case the DWP try to tell you otherwise :

DMG Chapter 53 53014. 4.

53014 The conditions1 referred to in DMG 53013 are that the claimant is :

1. entitled to ESA or an advance award of ESA2 has been made (DMG 53200 et seq)

and

2. not a member of the support group

and

3. under the age at which a woman of the same age as the claimant attains pensionable age (see DMG Chapter 75)

and

#4. not a person who is only entitled to ESA(Cont) payable at nil rate#

5. not a lone parent who is responsible for and a member of the same household as a child aged under one.

From : www.gov.uk/government/uploads/system/upl...e/297548/dmgch53.pdf

As you don’t have to comply with WFI’s you don’t have to comply with WRA either.

Hi d,

I see that the page that I posted the link to has changed.

I have now edited the link to take you to DM Guide CH 53.

The relevant extract is at 53014. 4.
