Hello,

My husband has received his invite to apply for PIP.

The letter states that of he applied BEfoRe 16/4/14 his DLA will continue until a decision is made.

It also states that if he does NOT apply before 16/4/14 his DLA will be stopped temporarily.

His DLA is due for review in August - does this mean if he applied before April and they turn him down the payments will be stopped before August thus his motability will be stopped and we will have to return the car before the expected due date.

The reason I think they may stop it is because they have just found him fit for work through ESA which we are requesting a mandatory reconsideration on.


We want to purchase the car at the end of the 3 years and that date is August.

Grateful for any help.

As you are one of the first members to report an invitation to claim PIP I just want to go through the process in detail.

As the letter says, your husband has until 16 April to make a new claim for PIP.

If he does not, then his DLA payments will be suspended and he will be given a further four weeks to make a claim for PIP, if he still does not do this then his DLA claim will be closed from 17 April 2014.

If he does, then he will be sent a PIP2 form to complete, this is analogous to the ESA50 that he completed and will capture any problems that he has with his day to day activities, this form normally has to be returned within four weeks of the date on the accompanying letter.

If the PIP2 form is not returned on time then he will likely be classed as failing his PIP claim (see on going DLA payments below).

Once the form is returned, he will likely be asked to attend an assessment; ATOS are doing most assessments at one of their PIP assessment centres, these should be different from their ESA ones, Capita are doing most assessments in the home.

The assessor will produce a report and send a copy to the DWP for a Decision t be made.

Once a Decision on your husbands PIP claim has been made he will receive a Decision Notice.

His DLA will remain in payment until four weeks after a Decision on his PIP claim is made, whether this is a positive one or negative, the DWP are allowing 20 weeks for the process to happen, at the moment, new PIP Claims are taking far longer than this for a Decision to be made, so I think it unlikely that any new Decision will be made before his DLA would have renewed.

Our understanding is that ESA assessment reports will not be used in connection with a PIP claim, this is a change from DLA where they could be.
