I NCAPACITY BENEFIT was created by karon
HI called the jobcenter today for my nephew, had no letter to say why his money had been stopped , i know there is a change from IB to ESA no mention of that just cancelled, i thought that by law they should of wrote , im waiting for them to call back they said up to three hours time , that time has passed , he is getting DLA i know that is changing to PIP , ,ive been waing for an appointee letter as he has mental health issues, they have ignored all my letters relating to my nephew, im fed up with their system can you give me advise if i can take out a civil claim against the people who im writting to as they are ignoring evidence many thanks

As a general rule, the public cannot sue the Government or a Government department, although there are processes for seeking redress, however, none of these are available to you at the moment as you have not exhausted processes that are available to you at the moment i.e. an appeal.
If you have not had a call back within the three hours then you need to contact the DWP again and make a formal complaint, unfortunately any new call back is now unlikely to happen before tomorrow morning.
You can contact you MP, or rather your nephew's MP, to ask for their assistance, whilst they cannot interfere in the DWP's processes they are often able to remove any "road blocks" that are in the way of them moving forward.

you were right about them not calling back , i had a feeling they werent going to call me back today,
any way about not being able to sue the goverment , i thought if i had a name to whom ive been dealing with they are responsible for their action , or non actions
,he who acts through another does the act himself
,the treatment of my sister and nephew, i will stand their corner, and fight their case to the end , even though this realy does interupt my life in having to find out everything, i called the ICS today they were good and gave me some advise
without me my family would be in a terrible state, i feel the weight of this on my shoulders,its a good job ive got big shoulders

Realistically though it is unlikely to change or improve your situation. I am glad you have been able to access advice. It sounds like your sister and nephew are lucky to have you.

hi puccalove , bless you ,i would help anyone , when its your family its real personal and you get so envolved, i try and not get so uptight, but family or not i dont like what is going on with the DWP and how its so unfair nite karon
