DLA Query was created by Billy
Hi
This morning an 8 page letter came from the DWP stating the purpose of this letter
Is to give you proof of entitlement
Information about changes you must tell us about and other information, etc

In the letter is states you must contact us if you go into hospital
Iam unclear about some aspects of this and I would be gratefull if you can advise me on two of these matters

I was awarded DLA on what I will call my original condition

There is a possibility that I may have to go into Hospital for an operation that is a completely seperate condition and is not connected at all from my original decision

1/ Do I still have to contact the DWP that if I go into hospital for this newer condition in which I did not claim DLA for this condition

Secondly it states " If there is any changes in how your health condition or disability affects you then we may ask you to make a claim for PIP

How can I state that there is changes in my health condition when I did not apply for DLA under my newer condition

Bud

Going into hospital for any reason is relevant. This is because DLA is for care and mobility needs and the DWP assume these will be provided for whilst in hospital.

DLA is not awarded for a specific condition but for care and mobility needs. Any increase in these needs is relevant. (Although if you are already on the high rate it will have no real affect on your entitlement.)

It is possible if you report a change you will be sent a PIP form depending on where you live. You should bear in mind if you do not report a change at the time it may be queried as to why later.

Although all deteriorations in condition were supposed to now initiate a PIP claim I believe you actually have to be in a reassessment area. The following map should help determine whether you are in one of these areas;

Although you need to tell the DWP whenever you are in hospital as an in-patient it will not have an effect on your DLA if the period is less than 28 days, but you should be aware that multiple periods can be accumulated together if they are seperated by less than 28 days, so if you spend 5 days in hospital, go home for the weekend and then stay in hospital for another 4 days; then this will count as nine days (see below).

The day you go into hospital and the day you leave are not counted.

Yes I understand it to be 28 days The clock starts ticking as it were, the first full day after admission. It stops ticking the day before discharge. Any period of 28 days within a 52 week period can begin to possibly affect entitlement on the 29th day. This is to the best of my knowledge. An overnight stay, perversely isnt counted as admission as the in patient is only counted as such the day after his admission, but is not seen as an in patient from the day before his discharge. Therefore he is discharged before being admitted, according to the rules. Confused? Youre meant to be. But any stay of less than 28 days isnt counted and entitlement would continue

Hi P
Iam in one off these area`s it started on the 14th of March, just my luck.
I certainly dont want to apply for PIP just yet, but on the other hand my evidence is upto date and relevant, I might have a better chance of being awarded PIP at this time, but who can tell
