Hi can any one help - I have been om ESA contribution based for nearly a year now finishes 17 Mar 2014. I appealed and lost to be put in support group(should of joined benefits advice sooner).

I have filled another ESA50 which was sent to Atos on the 14 Feb on the basis that my medical condition has got worse.

I have spoken to the benefits agency and have adviced me just to wait which will obviously be when me current ESA expires. I am aware i can resubmit forms for ESA income related .

What is the best direction I should take.

I am also in receipt of a occupational pension which i have read somewhere that they cannot take this into account if it was before 1999 as long as there have been no breaks in your benefits claims and am concerned that if i have a small gap when my ESA runs out will this then have an effect on future claims.

Hi j,

If you are placed into The SG as a result of this recent reassessment, (14/02/14) payment of your CB ESA will be reinstated from the date of the SG decision, and will remain in payment for as long as you stay in The SG.

If this review does not place you into The SG, you can request a Mandatory Reconsideration/Appeal of that decision. However, payment of you CB ESA would still cease on 17/03/14.

If your CB ESA does cease, you will continue to receive NI Credits that go towards your State Pension only.

You could ask to be financially assessed to see whether you qualify for payment of Income Related (IR) ESA, this is done by requesting and filling in an ESA 3 Form.

With regards to your OP, whereas it may have been disregarded when you were successfully transferred to CB ESA :

Will my pension be disregarded under ESA?

If you are assessed for entitlement to IR ESA (The means test) it will be counted as household income £ for £, so depending on how much your OP is, it may preclude you from any payment of IR ESA.

You would not know this until you were financially assessed using ESA 3 form.
