We did actually answer your question last night which is why we recommend that member stick to one topic where possible, but to answer it again.

You only have one month from the date of the Tribunal to request a written Statement of Reasons or the Record of Proceedings if you are looking at something from 2007 there is no chance that the information will be available.

Looking over your previous posts, I would not expect the Tribunal in 2007 to have taken any account of your brain haemorrhage in making the Decision as a Tribunal can only consider a claimants condition as it was at the time of the Decision appealed.

Thank you, only listed as a specific question as on reading original back rather thought I had lost that part within. I am aware nothing will or does relate to the brain injury as actually the tribunal hearing was before that accident, I know much additional facts regarding my claim were clarified in the tribunal which is why I asked but obviously that will not now be available, thanks for clarifying.

Hi N,

You can make a Subject Access Request to The DWP Data Controller for any information that they may hold on you.

How far back historically any information held will go, is an unknown.

The DWP state that they regularly destroy documentation after 14-18 months, and yet we are aware of people who have been able to obtain documentation from several years ago.

Hi Nichola,

I have every sympathy with you, I had an IUC 21/1/14 and by 10/2/14 I had my DLA high rate mobility suspended something which you cannot appeal so I am now waiting for Motability to give me a date for picking up the Motability vehicle. The Fraud officers do have video footage in my case it centered a lot around taking my grandson to and from school very very petty, and they also told me it was through an anyonomous phone call, I wish you all the best.

Hi
I was a benefit fraud investigator before losing my job due to ill health! Oh the irony! Although I did not investigate DLA I did work alongside the DWP who did.

They should not be interviewing you under caution unless they have sufficient evidence to contradict your last claim and with DLA they do tend to undertake surveillance of the person.
It is not a done deal that your benefit will be stopped, as the interview is your platform for explaining your circumstances. They will then do a report to a decision maker, based on the evidence and interview etc.

I feel that as long as you did not get your claim on the basis that you can never walk further than "X" metres etc etc and they are aware that you have good/bad days etc etc then you should be able to explain if they have filmed you doing something that they feel contradicts your claim. For example, if they had filmed you over a week and 5 out of the 7 days you took your dog on a long walk, they may say you just should not be getting High Rate Mobility.

Make sure you have a good look at your original claim form before going in so you are confident in what you put and just be honest.....don't tell fibs and say you have only walked the dog twice in 6 months if you have walked them more, or say you have only done gardening once in the last 6 months if you have done more, because if they have been filming you and this is not true this will go straight against you!

You are entitled to legal representation and if you cannot arrange this by the time of the interview, you are entitled to rearrange it to a more convenient time.

I appreciate this is a daunting and worrying time but just get as much evidence together as you can to support your claim and I wish you all the best.
