S/Worker filled in all the forms for me back then.
She gets Higher rate both componants.
I have recently found out that higher rate care means overnights?
Since she moved to live independantly she would only have night support by me or care agency when ill, the rest of the time she has a bed sensor alarm plus a neck pendant, commode at the side of the bed and grab rail to help herself up.
She didn't have these at home as i was on call for her, via the internal phone we had at the sides of our beds.
Her disability hasn't got any better infact in some ways it's worsened. It's just that these things were put in place when she moved.
I am thinking now that maybe I should inform DLA?
Having looked at the paper work it only says if a person gets better or worse we need to inform them.
Any advice please?

Hi pw,
Yes, HR Care means that the care in needed throughout the day, and the night.
As you rightly say a change of circumstances would only have to be reported to The DWP if your daughter's condition had improved or deteriorated, and due to either, her care needs had diminished or increased.
If this is not the case, then in my opinion, you would not have to report a C of C.
Of course, you would have to report the change of address.
The criteria for being awarded "Care" DLA is whether the "Care" is "Reasonably Required" not whether the claimant is actually receiving the "Care".
If that was the case, it would be most difficult for anyone living alone to receive "Care" DLA.
If you or anyone else is in receipt of The Carer Allowance (CA) or The Carer Premium (CP) for providing care for your daughter, there could of course be consequences with continued receipt of CA or The CP if they were no longer providing the requisite minimum 35 hours/week of care.

I changed her address with DLA when she moved.
She also has a clos-o mat toilet in her home as personal care in this area is needed without one she would need someone around most of the time.
No one gets carers allowance as I once did for her, instead she has direct payments to help with, personal care, dressing/undressing, preparing food etc.
She uses her powered wheelchair around her home as she can only walk a short distance and is prone to falls, because of the falls she has a Mangar elk lifting cushion.
You have put my mind at rest as I wouldn't want to be dishonest and not tell them.

From what you have posted, your daughter has a very high level of care needs, and seems more than entitled to The HR Care DLA.
If you still have any doubts, you are more than welcome to seek further professional advice.

Where to get advice?
I am sure that if any of the other Mods have a different viewpoint on this issue, they will add to my comments.
