Hello everyone, I joined this site when I claimed DLA in Jan 2013 and am awaiting a tribunal date. At that time I was in receipt of bereavement allowance for 52 weeks and since December have been on the basic rate of ESA of £71 awaiting an ATOS interrogation.
I am 59 years of age and for some years paid into my NHS pension which I can claim at age 60 April 2014. The pension will give me about £50 a week and a lump sum. Now out of the lump sum I have to pay for urgent repairs to my home which needs reroofing, new windows etc..so I expect there will be about £10,000 left in savings. What will the effect of all this be on my ESA payments because I cannot see me surviving on £50 a week and also need to keep some money behind me for rainy days

Your initial ESA will be based on your NI contributions and your assets and income. If you are placed into the WRAG, payment stops after 365 days unless the claimant is entitled to income-related benefit. There is no such time limit if placed in the Support Group.

12 Month Limit for ESA(CB)

It is possible that your lump sum will have dropped to below £6000 by the time your contributory claim ends but you should be careful to spend modestly and keep receipts so that you cannot be accused of 'Deprivation of Assets' As your weekly pension is less than £85, your ESA payments should not be affected but you should still notify DWP of this.

I is not clear from your last post when you last worked, so let me expand on Mrs H's advice.

If you have been working recently then you should qualify for Contribution Based ESA, this ignores pension income totalling less thanr £85/week and takes no account of any savings or assets that you have.

If you do not get ESA(CB) then you may be eligible for Income Related ESA which is dependant on your household income, your savings and assets, and any hours that your partner works. See

Asset rule for ESA(IR)

24 hour work rule for ESA(IR)

Your pension income will be classed as income and deducted pound for pound from your ESA(IR), also any saving in excess of £6000 will also result in a deduction as explained in the links above.

ESA(CB) is only payable for 365 days if you are placed in the ESA WRAG after which you can be assessed for ESA(IR), this rule does not apply if you are placed in the Support Group.
