please can u help, i today recieved a letter from the first-tier tribunal, social entitlement chamber, they are asking that my case be listed for an oral hearing on the first available open date with a standard time estimate as directed by the tribunal on the 13th december 2013, there are no exclusions(whatever that means i dont know), they are saying the tribunal needs to see me in person to talk to me about my problems and how they have changed since 2010, i am a long term sufferer of secondary care fybromyalgia, i was awarded the higher rate dla of care and mobility in 2011 after a long battle to get it, i have suffered with this condition for 19 years now, at present my 19yr old daughter is my full time carer, and i am virtually house bound,to the point that when i have to venture out i suffer real bad panic and anxiety attacks, when i put in for a review of my esa, i was asking that i be put on the support group rather than be kept on the wrag group, as my condition has got worse in the past 3years, to the extent my daughter had to get me in an occupational therapist to get aids for my home, and as i said i am virtually house bound now, also in the letter they said if i dont attend and my appeal is decided on the papers that they have, it might not go in my favour, and that my esa will stop if i lose my appeal, can this be done??.... Personally i do not wish to attend the hearing, and would like advice on this matter how i can put it across to them, i have sent relevant paperwork to them from my occupational therapist to back my case up also, but this does not seem to be enough, i do not know what else to do, and this is making me very ill with worry can you advise the best way of dealing with this. many thanks Margaret.

You probably don't want to hear this but you are much more likely to be successful if you attend your appeal. If you lose your appeal your benefits should not stop but you will stay in the WRAG. This means you will have to attend work focused interviews and if you do not attend those then your benefits can be stopped. You will want to weigh up one scary day with a potentially very positive result compared to many more scary days and potentially losing your benefit.
