DLA/ESA review triggered by carer credit claims? was created by nofuss
Hi
I appreciate that specific guidance isn't offered on this website/forum regarding Carers Credits applications - However, as it does concern my ESA/DLA awards, I hope it will be permissible for me to ask for others' experiences as to whether their DLA/ESA awards were re-examined/re-opened as a result of their carer claiming Carer's Credits. (Even just brief 'yes' or 'no' replies would be of great help to me.) I am concerned about this because...
I am in receipt of 'indefinite' DLA (and understand that it is unlikely that I will be asked to apply for PIP until Oct 2015) plus I am also in the contributions ESA Support Group, a benefit that I have only been in receipt of for a few months (which was hard fought for with the aid of the Benefits and Work excellent guides and the forum moderators' invaluable advice).
My husband is thinking of claiming for Carer Credits as we appear to meet all the requirements for that, i.e. my DLA is middle rate care, my husband doesn't have an income of more than £100 week and I need at least 20 hours of care/help from him per week. (He wants to claim Carer Credits in order to add to his National Insurance contributions/credits for his state pension - as I understand that Carer Credits are essentially Class 3 National Insurance Credits).
As previously mentioned, my query is whether anyone can advise me whether or not, when their own carer put in a claim for Carer's Credits, it triggered a review by the DWP of the person being cared for's DLA award and/or a requirement for them to claim PIP earlier than scheduled - I am also frightened that my husband claiming Carer Credits might trigger them reviewing my ESA too.
[The form for claiming Carer Credits doesn't state that they will look into the ins and outs of the person who needs care's DLA award at all - However, although my husband isn't intending to claim Carer's Allowance, we noticed that the form for Carer's Allowance does mention that they will scrutinise the DLA claim of the person for whom the claimant is caring. We are wondering whether, although not mentioned, this is also what happens in practice when a claim is made for Carer Credits.]
Thank you in anticipation of anyone's thoughts/experiences of this; I will be very obliged to you.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

There are no guarantees in this situation, but your husband claiming the Carers Credit should not be considered a Change of Circumstances for DLA and therefore should not result in any re-assessment, I assume that you are currently in receipt of DLA with MRC or HRC, so you are, by definition, in need of care, even if you are not currently receiving it.
Any likely "scrutiny" will simply to ensure that the eligibility criteria are met.

Thanks very much, Gordon. That's really helpful - Yes, I am indeed on DLA MRC.
